Escapeburn SuperTerminal Terms of Use

Effective: 13 October 2026

These terms are a contract between you and Escapeburn. Please read them: they explain what SuperTerminal does, what you are responsible for when AI agents work on your computer, and the limits of our liability.

1. Who we are and what these terms cover

"Escapeburn", "we" and "us" mean Escapeburn, a technology company in the process of registration in the Republic of Serbia. Until the registration is complete, the services are provided by the founder of Escapeburn, doing business under the name Escapeburn. Once the company is registered we will publish its registered name, registration number, tax number and address on this page, and these terms continue with the registered company; you agree that we may transfer them to it.

These terms apply to Escapeburn SuperTerminal for Windows, Escapeburn SuperTerminal for Android, the team server host package, the Escapeburn account at account.escapeburn.com, the update and download services, and any related services we provide (together, the "Services"). The software itself is the "Software".

By installing, opening or using the Software, or by creating an Escapeburn account, you accept these terms and our SuperTerminal Privacy Policy. If you use the Services for a company or another organisation, you confirm that you may accept these terms on its behalf, and "you" includes that organisation. If you do not accept these terms, do not use the Services.

2. Who may use SuperTerminal

You must be at least 16 years old, or older if the law where you live requires a higher age to accept these terms on your own. You must be able to enter into a binding contract and must not be barred from receiving the Services under applicable law, including sanctions laws.

3. What SuperTerminal is

SuperTerminal is a desktop tool that opens real command-line programs of other companies (such as Claude Code, Codex, Grok and Antigravity, the "Third-Party CLIs") in terminal tabs, together with tools around them: git worktree isolation, project memory, session history, a built-in browser and desktop automation, voice input, a video studio, Pixel (an assistant that routes your requests to your sessions), team features, a phone app and a remote project link.

SuperTerminal is a tool. You decide what you ask the agents to do, which projects they work on, which permissions they get and which accounts they use. We do not see, review or control the instructions you give, the code or files the agents read or change, or the commands they run.

4. Your Escapeburn account and beta access

Some features need an Escapeburn account. Keep your sign-in details secret and tell us at contact@escapeburn.com if you think someone else has access to your account. You are responsible for activity under your account.

SuperTerminal is currently offered as a free beta. Access is granted for the period shown in your account (usually 30 days), through our approval or an invite code, and we may extend, limit or end it at any time. A beta account is personal and may be used on the number of devices shown in your account (one by default). You must not share your account, sell or transfer access, or try to bypass the access check, the device limit or any other technical limit.

If we introduce paid plans, they will have their own price and terms, shown to you before you buy. Nothing is charged without your explicit agreement.

5. Licence

Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the Software for your own personal or internal business purposes during your access period. The team server host package may be installed only on servers you or your team control.

The Software is licensed, not sold. Escapeburn and its licensors keep all rights not expressly granted. You must not, and must not let others: copy, sell, rent, sublicense or distribute the Software or access to it; remove or change notices; reverse engineer, decompile or disassemble it except to the extent the law allows despite this restriction; circumvent licence, access or security mechanisms; use the Software to build a competing product; or use the Software or the Services in breach of these terms or the law.

Open-source components included in the Software are licensed under their own licences, listed in the third-party notices. Those licences take precedence for those components, and nothing in these terms limits the rights they give you.

6. AI agents act on your computer: your responsibility

The Third-Party CLIs are AI agents. Depending on the permission mode you choose (for example a mode that skips permission prompts), they can read, create, change and delete files, run programs and commands, install software, access the network, use your browser sessions and other accounts you connect, and use up your subscription limits, without asking you each time. AI agents can misunderstand instructions, make mistakes, follow malicious content they read (prompt injection) and act in ways you did not expect.

You are solely responsible for: choosing the permission mode and the folders, tools and accounts each session may use; reviewing what the agents do and propose before you rely on it; keeping current, separate backups of anything important; running untrusted code or projects only in an environment you are prepared to lose; and the consequences of commands, changes and actions carried out at your instruction or with the permissions you gave.

Features that limit risk, such as worktree isolation, guarded configuration files, secret masking and approval prompts, reduce but do not remove these risks. They are not a guarantee that data will not be lost, leaked or damaged.

7. Third-party services and providers

To use the agents you need your own accounts and subscriptions with their providers (for example Anthropic, OpenAI, xAI or Google). Your use of those services is governed by your agreements with those providers and their usage policies, which you must follow. We are not a party to those agreements, we do not resell or provide those services, and we are not responsible for their availability, quality, pricing, limits, outputs or decisions, including any decision to limit or suspend your account.

We respect the rules providers set for their services. SuperTerminal does not offer features that make your subscription available to other people where the provider's terms forbid it: sharing a subscription with teammates is switched off for providers whose terms do not allow it, and each person uses their own sign-in. We do not support, encourage or permit using SuperTerminal to break a provider's terms, and you must not use it for that.

Some features use your own sign-ins on your own computer: for example, reading the usage and limits of your subscriptions, or helper tools that run another Third-Party CLI you have installed (such as Antigravity for web search and media analysis, or Codex for image generation). These run only on your device, with your accounts, count against your own plans and are subject to those providers' terms. You decide whether to install and sign in to those tools.

Links, integrations and downloads of third-party software (CLI installers, browser pages, connectors, voices, fonts, models and other components) are provided for convenience. Their own terms and licences apply, including non-commercial or attribution conditions shown in the app, and you are responsible for complying with them.

8. Acceptable use

You must not use the Services to:

  • break any law or anyone's rights, including intellectual property, privacy and data protection rights;
  • access, test, scan or attack systems, networks or accounts without the owner's authorisation, or create or spread malware;
  • collect data from websites or services in breach of their terms or the law, or send spam;
  • create or spread content that sexually exploits minors, promotes violence or terrorism, or harasses, threatens or defrauds others;
  • break the terms or usage policies of a provider, including by sharing, reselling or pooling accounts or subscriptions, or by circumventing their limits;
  • interfere with, overload or attempt to gain unauthorised access to the Services, our servers or other users' devices, or misuse the bug report and feedback channels;
  • help anyone else do any of the above.

We may investigate suspected violations and suspend or end access to protect users, providers, third parties or the Services.

9. Your content and feedback

Your projects, code, files, prompts and outputs remain yours, as between you and us. The desktop app works on your computer; we do not receive your project files, terminal output or prompts, except the limited data described in the Privacy Policy (for example a bug report you choose to send).

If you send us feedback, ideas or bug reports, you allow us to use them to improve our products without any obligation to you. Do not include secrets, other people's personal data or confidential material in reports.

10. AI output

Output produced by AI agents, Pixel or other AI features may be incorrect, incomplete, insecure, outdated or similar to existing material owned by others. It is not professional advice. You are responsible for checking output, including code, licences and facts, before using, publishing or relying on it.

11. Teams, project link, team servers and the phone app

Team features, the remote project link, team servers and the phone app connect your devices with devices you choose. People and devices you connect may see, use and change the projects, terminals and information you share with them, and a team server's operator can see everything that runs on that server. Only connect people and machines you trust, review what you share, and remove access you no longer want.

You are responsible for the people you invite, for the servers you add (including their security, updates and the laws that apply where they run) and for the phone you pair. Your teammates must accept these terms to use SuperTerminal.

12. Automation of browsers, desktop apps and phones

The built-in browser, desktop automation and phone control act with your sign-ins and on your behalf when you or your agents use them. You are responsible for the actions taken, for complying with the terms of the websites and apps involved, and for confirming sensitive actions such as payments, messages or account changes. SuperTerminal asks for approval in some cases, but it cannot know the consequences of every action.

13. Updates, beta status and changes to the Services

The Software checks for updates and installs signed updates automatically, as described in the app. Some features need a current version. The Services are in beta: they may change, contain errors, be interrupted or be discontinued, in whole or in part, at any time. We are not obliged to provide support, maintenance or any particular feature.

14. Disclaimer of warranties

To the fullest extent permitted by law, the Services and the Software are provided "as is" and "as available", with all faults and without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security and that the Services will be error-free or uninterrupted. We do not warrant any output, any Third-Party CLI or any third-party service.

15. Limitation of liability

To the fullest extent permitted by law, Escapeburn, its founder, team members and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, files, code, profits, revenue, business, goodwill or subscription quota, any cost of replacement services, or any damage to devices or systems, arising out of or in connection with the Services, the Software, AI agents, Third-Party CLIs, third-party services, automation, team features or these terms, even if we were told such damage was possible.

To the fullest extent permitted by law, our total liability for all claims arising out of or in connection with the Services or these terms is limited to the greater of the amount you paid us for the Services in the twelve months before the event giving rise to the claim and fifty euros (EUR 50).

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for damage caused intentionally or through gross negligence, for death or personal injury, or your mandatory rights as a consumer.

16. Indemnity

To the extent permitted by law, you will defend and compensate Escapeburn, its founder and team members against claims, losses and costs (including reasonable legal fees) brought by third parties that arise from your use of the Services in breach of these terms or the law, from the instructions you gave to AI agents, or from content, code or data you processed with the Services. This does not apply to the extent a claim was caused by our own breach of these terms.

17. Suspension and termination

You may stop using the Services and uninstall the Software at any time, and ask us to delete your account. We may suspend or end your access, with notice where reasonable, if you break these terms, if required by law or a provider, to protect the Services or others, or if we discontinue the Services. When access ends, your licence ends and the Software may lock itself; sections that by their nature should survive (including 6, 7, 9, 10 and 14 to 22) continue to apply.

18. Consumers

If you are a consumer, you keep all rights that the law of your country of residence gives you and that cannot be waived by contract. These terms do not limit those rights. Because the beta is free and starts immediately at your request, statutory withdrawal rights for paid digital content do not apply to it; any future paid plan will state your withdrawal rights before purchase.

19. Export and sanctions

You must comply with export control and sanctions laws that apply to you and to the Software. You must not use or export the Services to a country, person or purpose prohibited by those laws.

20. Trademarks

Escapeburn, SuperTerminal, Pixel, Comet and their logos are trademarks of Escapeburn. Claude and Claude Code are trademarks of Anthropic, PBC. OpenAI, ChatGPT and Codex are trademarks of OpenAI. Grok and xAI are trademarks of X.AI Corp. Google, Gemini, Antigravity and Android are trademarks of Google LLC. Windows is a trademark of Microsoft Corporation. Escapeburn SuperTerminal is an independent product and is not affiliated with, endorsed or sponsored by these companies; their names are used only to describe compatibility.

21. Governing law and disputes

These terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods. Disputes are decided by the competent court in Serbia at Escapeburn's registered seat. If you are a consumer, you may also bring proceedings, and benefit from the mandatory consumer protection rules, of your country of residence. Before going to court, please contact us so we can try to resolve the issue; consumers in Serbia may also use out-of-court consumer dispute resolution under Serbian law.

22. Changes to these terms

We may update these terms, for example when we change features, the law changes or the company registration is completed. We will publish the new version on this page with its date and, for material changes, tell you in the app or by email before they take effect. If you keep using the Services after the change takes effect, the new terms apply; if you do not agree, stop using the Services.

23. General

These terms, together with the Privacy Policy and any terms shown for a specific feature, are the entire agreement between you and us about the Services. If a provision is invalid, the rest remains in force and the invalid provision is replaced by a valid one that comes closest to its purpose. Not enforcing a right is not a waiver. You may not transfer these terms without our consent; we may transfer them to the registered Escapeburn company or as part of a reorganisation or sale. The English version is binding; translations are for convenience.
